3. Client Engagements and Contracts

For clients engaging us for custom development or consulting services, specific project scopes, deliverables, timelines, and payment terms will be governed by a separate Master Services Agreement (MSA) or Statement of Work (SOW). In the event of a conflict between these Terms of Service and a signed MSA/SOW, the MSA/SOW shall prevail.

4. Shopify Applications

If you install or use any Shopify applications developed by Opticlon Technologies, you agree to comply with Shopify's Terms of Service in addition to our own. You grant our applications the necessary permissions to access your Shopify store data solely for the purpose of providing the application's intended functionality. We are not responsible for any disruptions to your store caused by third-party conflicts or Shopify platform changes.

5. Intellectual Property Rights

Unless otherwise stated in a specific contract, all materials, codebases, designs, graphics, and software created by Opticlon Technologies prior to the full payment of associated invoices remain the exclusive property of Opticlon Technologies.

Upon full payment, intellectual property rights will be transferred to the client as outlined in their respective agreement. The Opticlon Technologies brand, logo, and website content are our intellectual property and may not be used without written permission.

6. User Responsibilities

When using our website or services, you agree not to:

• Use the services for any illegal or unauthorized purpose.
• Attempt to hack, disrupt, or compromise the security of our servers or networks.
• Reproduce, duplicate, copy, or resell any part of our services without our express written permission.
• Provide false or misleading information when requesting quotations or submitting forms.

7. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Opticlon Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) our services.
• Any conduct or content of any third party on the services.
• Any unauthorized access, use, or alteration of your transmissions or content.

8. Disclaimer of Warranties
